2. Scope of services
Website design and development, content preparation, deployment, domain, hosting and SSL configuration, and post-launch support – in the scope agreed with each client.
3. How I work
- 3.1 Independence. I provide services as an independent business (B2B). No engagement creates an employment relationship, partnership or joint venture.
- 3.2 Scope and result. The client defines the objective and the expected result. I decide how it is achieved – technical solutions, tooling and sequencing.
- 3.3 Paid for results. I am paid for delivered and accepted work, not for time spent being available.
- 3.4 Own resources. I work on my own equipment, software and licences.
- 3.5 No exclusivity. I serve several clients in parallel and may take on new work during an engagement.
- 3.6 Subcontractors. I may delegate parts of the work (e.g. photo/video production), remaining responsible to the client for the result.
4. Formation of contract and pricing
Prices shown on this site and in the calculator are indicative, net, and constitute an invitation to treat rather than a binding offer. A binding quote is issued in writing or by email once the scope is agreed. The contract is concluded when the client accepts the quote and scope.
5. Delivery and acceptance
Work proceeds in the stages set out in the quote. The client raises comments within the agreed window; no comments within that window means the stage is accepted. Work beyond the agreed scope is quoted separately.
Delivery timelines start once the client has supplied the complete content and materials required for the work.
6. Payment
Fees are payable against an invoice issued by mackan.it Maciej Kankowski. Standard payment term is 14 days from the invoice date unless agreed otherwise. Prices are net; VAT is added at the applicable statutory rate.
For project work the standard split is: 50% of the fee as a deposit once the quote and scope are accepted, the remaining 50% on acceptance, before the site goes live on its target domain. Paying in full up front qualifies for the discount stated in the quote.
Costs of third-party services and licences purchased on the client’s behalf – in particular domains, licences, third-party tool APIs and payment gateways – are not included in the fee and are billed separately at the providers’ invoiced cost, unless the quote states otherwise.
If payment is more than 14 days overdue I may suspend further work and care services until the balance is settled. Statutory interest for late payment applies.
7. Post-launch care and subscription
- 7.1 First year included. Unless the quote states otherwise, the fee for building the site covers hosting, domain, SSL certificate and post-launch care for 12 months from launch.
- 7.2 Continuation. After that period, care continues on a paid basis under one of the subscription plans shown on the site, ordered separately by the client. Without such an order, care ends after the 12 months.
- 7.3 Billing. Subscriptions are invoiced in advance for each billing period. Paying yearly in advance qualifies for the discount stated in the price list.
- 7.4 Termination. Either party may cancel the subscription with effect from the end of the paid billing period, without giving a reason and without additional charges.
- 7.5 Change hours. Change hours included in a plan do not roll over between billing periods. Work beyond the plan is quoted separately.
- 7.6 Response times. Stated response times apply to incident reports on business days and mean the time to start work, not the time to resolve the incident.
- 7.7 End of care. When care ends I hand over a copy of the site and access to the domain and hosting to the extent that I hold them. I use no technical lock-in preventing a move to another provider.
8. Warranty, risk and liability
- 8.1 Warranty. I warrant that accepted work conforms to the agreed scope.
- 8.2 Defect remediation. Defects reported during the support period are corrected at my own cost.
- 8.3 Economic risk. I bear the economic risk of my work: fixed-price work exceeding my own estimate is not re-billed, and rework caused by my error is not chargeable.
- 8.4 Cap. Unless mandatory law provides otherwise, my liability towards a non-consumer client is limited to the fees payable under the relevant contract.
- 8.5 Exclusions. I am not responsible for content or materials supplied by the client, nor for third-party services (hosting, domain, third-party tools) beyond my own configuration of them.
9. Intellectual property
Economic copyright in works created to the client's order transfers to the client upon payment in full, on the fields of exploitation set out in the contract. I retain rights to pre-existing components, general-purpose tooling and know-how developed independently of the engagement, and grant the client a licence to use them as embedded in the delivered website.
I retain the right to present completed work in my portfolio unless the client states otherwise.
10. Consumers – right of withdrawal
A client who is a consumer, or a sole trader with consumer rights, may withdraw from a distance contract within 14 days without giving a reason. If the consumer requests that performance begin before that period expires and expressly acknowledges losing the right of withdrawal once the service is fully performed, the right expires upon full performance. On withdrawal after work has begun, the consumer pays for services rendered up to the point of withdrawal.
11. Complaints and termination
Complaints are accepted by email and handled within 14 days. Either party may terminate on the terms set out in the contract. On termination, work completed and accepted up to that date is invoiced and paid.
12. Personal data
Personal data processing is described in the Privacy policy.
13. Governing law
Polish law applies. Disputes with non-consumer clients are subject to the court having jurisdiction over the provider's registered seat. A consumer may use out-of-court complaint and redress procedures, for example through a municipal or district consumer ombudsman (rzecznik konsumentów) or the regional Trade Inspection (Inspekcja Handlowa).
